LEGAL UPDATE Fatal Fall Results in
$49,000 Fine OSHA cited David Burke Construction LLC of
Hamburg, N.Y., for alleged repeat and serious violations of fall
protection safety standards after an employee fell 30 feet to his death at
a Buffalo worksite on March 20. The employees were working on the second
floor, at the edge of deteriorated and missing floor sections that opened
to the building's basement, when an employee fell through the missing
floor section. The company has 15 business days from receipt of the
citations to request and participate in an informal conference with OSHA's
area director or to contest the citations before the independent
Occupational Safety and Health Review Commission. For more

Refuse Hauler Fined After
Employee Crushed by Container OSHA cited Deffenbaugh
Industries Inc. of Omaha for two alleged willful violations and proposed
penalties totaling $125,000 following an employee fatality in November
2006. A Deffenbaugh employee sustained fatal injuries when a six-yard
refuse collection container swung free from the back of a collection
truck, crushing the employee between the truck and the container. The
firm has 15 working days from receipt of the citations and proposed
penalties to comply, request and participate in an informal conference
with the OSHA area director, or contest the citations and penalties before
the Occupational Safety and Health Review Commission. For more
